• Multi-channel communication through SMS, Live Chat, and Messenger

Our services are intended for use by healthcare providers and their authorized staff. We are not a healthcare provider and do not provide medical advice, diagnosis, or treatment.

3. Opt-in and SMS Messaging Policy

Voxcon.AI offers SMS-based communication services for healthcare providers. By opting in to receive messages, you agree to:

• Receive SMS messages related to healthcare inquiries, appointment scheduling, and follow-ups.
• Message frequency varies, typically based on your interaction with our services.
• Message & data rates may apply depending on your carrier plan.
• You can opt out anytime by replying "STOP" to any message.

• Carriers supported: AT&T, T-Mobile, Verizon, Sprint, and most other major carriers.
• T-Mobile is not liable for delayed or undelivered messages.

By providing your phone number and opting in, you confirm that you are the subscriber to the relevant phone number or have the subscriber's permission to receive SMS messages at this number.

4. User Responsibilities

When using our services, you agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Use our services in compliance with all applicable laws and regulations
• Not use our services for any illegal or unauthorized purpose
• Not attempt to interfere with or disrupt our services
• Not attempt to access data not intended for you
• Not use our services to transmit any material that contains viruses, trojan horses, or other harmful code

5. Healthcare Provider Responsibilities

If you are a healthcare provider using our services:

• You are responsible for obtaining appropriate consent from patients before using our services to communicate with them.
• You are responsible for ensuring that your use of our services complies with all applicable healthcare laws and regulations, including HIPAA where applicable.
• You acknowledge that we are not a covered entity or business associate under HIPAA, unless a separate business associate agreement has been executed.
• You agree not to use our services to transmit protected health information (PHI) unless appropriate safeguards are in place.

6. Intellectual Property

Our services and all content and materials included on or within our services, including but not limited to text, graphics, logos, images, and software, are the property of Voxcon.AI or our licensors and are protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our services without our prior written consent.

7. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT OUR SERVICES OR THE SERVER THAT MAKES THEM AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

8. Limitation of Liability

IN NO EVENT WILL VOXCON.AI, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, OUR SERVICES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

9. Indemnification

You agree to defend, indemnify, and hold harmless Voxcon.AI, its affiliates, and their respective officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of our services.

10. Termination

We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
